1. Intellectual Property Philosophy: Protecting Global Artistry
Nonlending respects the creative labor and intellectual property rights of artists, graphic designers, photographers, and content creators globally. As a premier provider of high-quality posters, bespoke wall art, and limited-edition prints, we understand that the visual and textual representation of art is a significant asset that requires rigorous legal protection.
In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we have established this comprehensive protocol to respond promptly and effectively to valid notices of alleged copyright infringement. Our primary operations at 925 W 72nd Ave, Anchorage, AK 99518 are committed to maintaining a digital gallery that honors the creative boundaries of copyright law.
We believe that a marketplace for art can only thrive when the rights of creators are prioritized. Whether it is an original abstract composition, a cinematic tribute, or a curated landscape photograph, Nonlending implements strict auditing to ensure our posters do not infringe upon the protected works of others. If you are a rights holder, we invite you to review our takedown procedures below.
2. Formal Takedown Notice Requirements: The DMCA Framework
If you believe that your copyrighted work—including but not limited to fine art photography, digital illustrations, poster design graphics, or unique product descriptions—has been utilized on nonlending.com without proper legal authorization, you or your designated agent must submit a formal written notice.
To be effective under the DMCA, your notice must be comprehensive and include the following mandatory elements:
- Identification of the Copyrighted Work: A sufficiently detailed description of the work you claim has been infringed (e.g., “Original Digital Illustration of the Aurora Borealis Series”). Providing a registration number or a link to the original work is highly encouraged.
- Specific Location Mapping: The exact URL(s) on our website where the allegedly infringing poster or image is located. General site names are insufficient; we require direct paths to the content in question.
- Claimant Contact Information: Your full legal name, physical mailing address, telephone number, and a verified professional email address for official correspondence.
- The “Good Faith” Statement: A clear, unambiguous statement that you have a “good faith belief” that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Perjury Statement: A statement, made under penalty of perjury, that the information provided in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Formal Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
3. Internal Audit & Expedited Action Plan
Upon receiving a notification that complies with the technical requirements of the DMCA at our Anchorage headquarters, Nonlending will initiate the following internal response plan:
- Immediate Technical Review: Our legal compliance team will evaluate the notice for sufficiency and verify the location of the art piece on our servers.
- Expeditious Removal: We will act with urgency to remove or disable access to the poster or visual material identified in the notice to prevent further potential infringement.
- Stakeholder Notification: We will make a good faith effort to notify the designer or vendor who provided the material, informing them of the takedown and providing them with a copy of your notice.
- Repeat Infringer Protocol: In accordance with federal law, Nonlending maintains a strict policy of terminating the accounts of partners, designers, or users who are found to be “Repeat Infringers.”
4. Counter-Notification Rights & Material Restoration
If you believe that your poster design or art image was removed or disabled by mistake or misidentification (e.g., you own the rights or have a valid license), you have the right to submit a Counter-Notification.
A valid Counter-Notice must be sent to our DMCA Agent at support@nonlending.com and must contain your contact details, identification of the material that was removed, and a statement under penalty of perjury that you have a good faith belief the material was removed in error.
If a valid Counter-Notice is received, the DMCA allows us to restore the art content within 10 to 14 business days, unless the original complaining party provides us with notice that they have initiated a court action seeking an order to restrain the allegedly infringing activity.
Cautionary Legal Notice: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing may be subject to liability for damages, including attorney’s fees incurred by Nonlending or the alleged infringer. Submitting a false DMCA claim is a serious offense with significant financial consequences.
