1. User Eligibility & Account Integrity

Age Requirement: You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to create an account or place an order for our art products. By using this site, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding contract.

Account Responsibility: If you choose to register for a “Nonlending Gallery Account,” you are solely responsible for maintaining the confidentiality of your login credentials and for restricting access to your computer or mobile device. You agree to accept full responsibility for all activities, purchases, and communications that occur under your account.

Right to Terminate: Nonlending reserves the absolute right to refuse service, terminate accounts, or cancel orders at our sole discretion. This typically occurs in cases of suspected fraudulent behavior, unauthorized use of our intellectual property, or any activity that compromises the integrity of our Anchorage-based printing and logistics operations.

2. Product Fidelity, Accuracy & Pricing Policy

Visual Accuracy: We strive to display the colors, textures, and fine details of our posters as accurately as possible. However, the physical reality of giclée printing on 200 GSM paper may vary slightly from digital renderings. Because the actual colors you see depend on your monitor settings and ambient lighting, minor variances in shade or saturation are not considered manufacturing defects.

Pricing & Manifest Errors: All prices are displayed in USD (United States Dollars). While we endeavor to ensure all pricing data is correct, errors may occur. In the event of a manifest pricing error (e.g., a large-scale archival print listed for an impossible price), Nonlending reserves the right to cancel the order, notify the customer, and provide a full refund.

Availability & Modifications: All items are subject to stock availability of premium paper and ink at our Anchorage fulfillment center. We reserve the right to modify prices, discontinue specific art designs, or change paper specifications at any time without prior notice.

3. Shipment Contract & Delivery Protocols

Nonlending ships exclusively within the United States. Every purchase made on our site is subject to a standard shipment contract with our partner carriers (FedEx, UPS, or USPS).

Transfer of Title: The risk of loss and legal title for your posters pass to you once we deliver the package to the common carrier at our Anchorage facility. We are responsible for ensuring the art is packaged in reinforced 3mm tubes; however, the carrier is responsible for the physical transit.

Delivery Issues: While we assist in tracking and filing insurance claims for transit damage, Nonlending is not legally responsible for packages once they are officially marked as “Delivered” by the carrier. We strongly recommend providing a secure delivery address to protect your artistic investments from theft or environmental exposure.

4. Proprietary Rights & Artistic Content Use

All digital and physical assets—including but not limited to the Nonlending logo, website graphics, exclusive poster designs, high-resolution photography, and editorial copy—are the exclusive intellectual property of Nonlending. These assets are protected by United States and international copyright, trademark, and trade dress laws.

Prohibited Use: Unauthorized reproduction, modification, distribution, or “scraping” of our art designs for commercial purposes is strictly prohibited. You are granted a limited license to access the site for personal shopping only. Any breach of our proprietary rights will result in immediate termination of service and potential legal action in the Anchorage jurisdiction.

5. Liability Limitations & Indemnification

Disclaimer of Warranties: Nonlending provides the website and products on an “as is” and “as available” basis. We do not guarantee that our digital gallery will be error-free, uninterrupted, or free of viruses.

Limitation of Liability: Nonlending shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our posters or the inability to access our website. This includes, but is not limited to, damage to walls during hanging or dissatisfaction with an artistic style. You agree to indemnify and hold Nonlending harmless from any claims, losses, or legal fees arising out of your breach of these Terms or your violation of any law or the rights of a third party.

6. Legal Jurisdiction & Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Alaska, USA, without regard to conflict of law principles.

Exclusive Jurisdiction: Any dispute, controversy, or claim arising out of or relating to your use of nonlending.com or the purchase of our posters shall be subject to the exclusive jurisdiction of the state and federal courts located in Anchorage, Alaska. By using this site, you waive any objection to such jurisdiction or venue.
